TERMS FOR PERSONAL PROPERTY
All items sell “as is, where is” with no guarantees or warranties express or implied. All purchases are considered verified by the purchaser as to grade and authenticity. The purchaser will rely solely on his/her judgment in any purchase.

Payment: The successful Purchaser(s) will make payment in full at the close of the auction in the form of cash, cashier’s check, credit card, money order or wire transfer. A 15% Buyer’s

Premium will be added to the bid price to obtain the contract price. Sales tax of 7% will be charged on all applicable purchases.
Dealers buying for resale may be exempt from paying sales tax if the dealer provides their sale tax resale number and executes the sale tax exemption form.

Possession of the personal property will be granted upon final payment. NO EXCEPTIONS.

Auction End Times: All Rowell Auctions, Inc. Online Real Estate Auctions are timed events and subject to extended bidding due to bidding activity. Rowell Auctions, Inc. reserves the right to adjust the auto extension time period.

Example: Rowell Auctions, Inc. Online Real Estate Auctions have a “Dynamic Close” auto extend feature. Once the bidding reaches 5 minutes before the scheduled bid closing, the “Rowell Dynamic Close” will begin. Upon receiving the first bid with under 5 minutes remaining, the bid closing will have an additional 5 minutes added. At that point the countdown continues. Example: If an auction scheduled to end at 2:00 p.m. receives a bid at 1:56 p.m., the close time of the auction automatically extends to 2:05 p.m. The auto-extend feature remains active until no further bids are received on the entire bidding group of properties within the 5 minute time frame. Rowell Auctions, Inc. reserves the right to adjust the auto extension time period.

Buyer’s Premium: A 15% Buyer’s Premium will be added to the bid price to determine the final sales price.

Buyer’s Premium Example: Bid Price: $10,000.00 Plus 15% Buyer’s Premium: $1,500.00 Sales Tax: 7% $805.00 Total Sales Price: $12,305.00

Personal Property Purchase Retrieval: All items are available for retrieval as follows:

Retrieval Times: Thursday, May 1st, from 8:00AM-5:00PM Friday, May 2nd, from 8:00AM-3:00PM

ALL equipment must be removed from the building during this time. Any purchaser needing additional time to remove equipment MUST make arrangements with the Auctioneers prior to bidding, NO EXCEPTIONS.

Shipping is not available for this auction. All items must be retrieved at the location listed above.

In order to retrieve purchases, a paid invoice must be presented at pickup location by purchaser or their representative. NO EXCEPTIONS.

VEHICLE TITLES
On all titled vehicles and trailers, titles will be delivered to the purchaser14 days after the auction via certified mail, return receipt requested. Any vehicle not requiring a title for transfer within the State of Georgia will be transferred by bill of sale only. Purchaser shall be responsible for all title registration tag transfer fees, and the Title Ad Valorem Tax fee which will be paid by the purchaser upon transfer of registration in the county of domicile.

ELECTRICAL DISCONNECTION
On all equipment electrically hard wired to the building it is the purchaser’s responsibility and expense to disconnect power at the nearest junction box. All exposed wires must be capped with wire nuts and taped.

ADDITIONAL AUCTION TERMS
Rowell Auctions, Inc. reserves the right to use Lots 565-575 (4 FT Gondola Shelving) during the two day load out period for load out purposes. These items will be available for retrieval the afternoon of Tuesday, May 2nd.

Lots 193 and 194 are selling subject to seller confirmation.

Lots 185-199 are located at 275 Youngstown Road, Blairsville, Georgia and will be retrieved from this location.

Rowell Auctions reserves the right to remove or cancel the bids and or bidding rights and privileges of any party at any time deemed not to be in the best interest of the seller.
All items are subject to prior sale or removal from the auction.

Software and Server Technical Issues: In the event there are technical difficulties related to the server, software or any other online auction-related technologies, Rowell Auctions, Inc., reserves the right at its sole discretion to extend bidding, continue the bidding, or close the bidding. THE COMPANY PROVIDING THE SOFTWARE nor Rowell Auctions, Inc. WILL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications are sent to registered bidders with updated information as deemed necessary by Rowell Auctions, Inc.
